Copyright & DMCA Policy

HouTV ("HouTV," "we," "us") respects the intellectual property rights of others and expects our users to do the same. Videos and other content on HouTV are uploaded by our users; HouTV does not pre-screen content. In accordance with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512, we respond to clear notices of alleged copyright infringement and maintain a policy of terminating, in appropriate circumstances, users who are repeat infringers.

This page describes how to submit copyright complaints and counter-notifications. It is provided for general information and is not legal advice. If you are unsure of your rights, consult an attorney.

1. Reporting alleged copyright infringement

If you are a copyright owner (or authorized to act on behalf of one) and believe that content on HouTV infringes your copyright, please send a written notification ("DMCA Notice") to our Designated Copyright Agent (Section 5). To be effective under 17 U.S.C. § 512(c)(3), your DMCA Notice must include substantially the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list);
  3. Identification of the material that is claimed to be infringing and that is to be removed or disabled, with information reasonably sufficient to let us locate it — e.g., the URL of the video on HouTV;
  4. Information reasonably sufficient to let us contact you, such as your name, mailing address, telephone number, and email address;
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Incomplete notices may delay our response. Please do not send notices for content you do not own or are not authorized to represent.

2. What happens after we receive a valid notice

Upon receiving a notice that substantially complies with the DMCA, we will expeditiously remove or disable access to the allegedly infringing material and will make a good-faith effort to notify the user who posted it. We may also document the complaint for purposes of our repeat-infringer policy (Section 4).

3. Counter-notification

If you are a user whose content was removed or disabled and you believe the removal was a mistake or misidentification, you may submit a written counter-notification to our Designated Copyright Agent. Under 17 U.S.C. § 512(g)(3), it must include substantially the following:

  1. Your physical or electronic signature;
  2. Identification of the material that was removed or disabled and the location at which it appeared before removal;
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which HouTV may be found), and that you will accept service of process from the person who submitted the original notice or their agent.

If we receive a valid counter-notification, we may restore the removed material in 10–14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

4. Repeat infringer policy

HouTV will, in appropriate circumstances and at our discretion, disable and/or terminate the accounts of users who are determined to be repeat infringers. We may also limit access to the Service for anyone who infringes the intellectual property rights of others, with or without notice.

6. Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees. Please be sure of your rights before submitting a notice or counter-notification.

8. Governing law

This policy and any disputes relating to it are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles, and supplement our Terms of Service.
